SimplTests provides a platform for teachers and educators to create tests, quizzes, and exams. The Service allows users to manually create questions or use AI-powered generation to create questions from provided context. Tests can be exported to various Learning Management Systems (LMS) including Canvas, Moodle, Blackboard, Kahoot, Google Forms, and Google Slides. Authentication and user account management are handled through Clerk.

2. Eligibility

You must be at least 13 years old (or the minimum legal age in your country) to use this Service. By using the Service, you represent that you meet these requirements.

3. User Accounts

To use certain features of the Service, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service to:

• Violate any laws or regulations
• Create content that infringes on intellectual property rights
• Distribute malicious software or interfere with the Service
• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any portion of the Service

5. AI-Generated Content

The Service uses AI technology (including OpenAI's GPT-4o) to generate questions. While we strive for accuracy, AI-generated content may contain errors. You are responsible for reviewing and verifying all AI-generated content before use. We are not liable for any issues arising from AI-generated content.

6. Credits and Payments

AI question generation requires credits, which can be purchased through our pricing page. Credits are non-refundable except as required by law. We reserve the right to modify credit pricing and requirements at any time.

7. Third-Party Services

The Service integrates with third-party services including Clerk for authentication, OpenAI for AI generation, Stripe for payments, and various LMS platforms for export. Your use of these services is subject to their respective terms and conditions.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free. We do not warrant that exported tests will be compatible with all LMS platforms.

9. Limitation of Liability

To the maximum extent allowed by law, we are not liable for any damages resulting from your use of the Service, including but not limited to direct, indirect, incidental, or consequential damages.

10. Changes to Terms

We may update these Terms at any time. Continued use of the Service after updates means you accept the revised Terms. We will notify you of significant changes by updating the date at the top of this page.
